Help a Single Father to see his daughter again and keep his two American Pitbull Terriers at the same time … Please help Fight BSL discrimination NOW
Louisville Attorney

Website about this issue: www.chako.org/durbin.html

Hello All,

Some of you may know already and some may not, but here is my story as it relates to BSL and my daughter, my dogs, and my life.

I have been going through a custody case for over 5 years, not that is what this email is about, but it gives a background. My daughter’s mother has used many excuses to try to prevent my visitation and custody and had eventually found one that stuck – my ownership of two American Pit Bull Terriers.

3 years ago, Judge Cynthia Sanderson of McCracken County, KY ordered to me keep my dogs away from my daughter while I have visitation. Reluctantly, I followed that order to the best of my ability although I had to go to court approximately 6 more times to explain it. This past January, I was told "for the last and final time" to keep my daughter away from my dogs or face jail time and/or loss of visitation.

This past Easter, which also was the last time I have seen my daughter, my five-year old beautiful daughter, cops were sent to my house along with my daughter’s mother very late in the evening claiming I was in violation of several orders, one of which of course was allowing the dogs around my daughter. My daughter was asleep in the bed while I fed my dogs. The police came in, and even reported that the dogs and my daughter were nowhere near each other, nor had they even had a remote chance of being near each other (doors closed, rooms separated, etc). Upon taking my daughter back to her mother’s two days later, she revoked my visitation claiming "endangerment" . I have not seen my baby since.

This past Friday, September 18th, 2009, I appeared once again before Hon. Judge Cynthia Sanderson with a legal aid attorney (I have lost a LOT of money through this ordeal), and was eventually told, AFTER showing evidence of no wrongdoing, compliance with the order, and various testimonies to prove that, I was told by the judge "I am not a dog person…I don’t care what you do. Get rid of these dogs or put them down. Bring me an affidavit that you have done one or the other, and you can see your daughter again." When I said once again that I will not even have the dogs at my home anymore when I have my visitation, I was told, "If I find out that you have the dogs at your home even after your daughter has left, I will put you in jail for 6 months. I am very serious about this. I am not a dog person."

This is absurd. I can get on my soapbox about several others rights violations but that is not the purpose of this email. The purpose of this email is to explain and ask why a person has to give up his/her rights to have companions, to own property, EVEN WHEN the child in question is not present, just to be a father to his child.

My dogs, APBTs, have had training, evaluations, and have never shown any history of violence or aggression, and in fact, were evaluated to be very gentle and loving dogs, especially with children. 3 years ago, I showed these FACTS, and these FACTS were not even looked at. All that could be said that I was endangering my daughter, and how could I do that, etc etc…I was told by Brian Katz, an attorney in McCracken County, that I was unfit to be a parent because of having two APBTs.

I cannot begin to describe my hurt. Not only have I not seen my daughter for almost 6 months because of this absurdity, I have lost nearly everything of value in this situation. PLEASE do not think that this is an issue of the importance of my daughter versus my dogs, that would be an insult. My daughter is my LIFE, but on average I am lucky to see her 100 days out of the year. The issue is that I am told my other companions are to be taken away or KILLED (simply because of breed); I am being told what I can and cannot do with my property. I am being told that I CANNOT RAISE MY DAUGHTER EFFICIENTLY BECAUSE I HAVE TWO APBTs.

My next step is to file a motion to amend this order, and my attorney, as gracious as she is, does not think there is any hope in that. I, for one, think that there is not a God in Heaven that would allow something like this to happen – to terminate my companions and my relationship with them, both my daughter AND my dogs. After that is the appeals process, which can take months and even years. I do not want to lose my companions. I do not want to lose my daughter, and I do not want to lose my four-legged children when my daughter is not there. As silly as it sounds, these dogs have gotten me through a lot more than any human can ever do. My daughter gives me something to live and work for, and when she isnt there, my other babies gives me something to come home to. I cannot begin to describe the feeling I get when I have had a bad day missing my daughter or even at work and to come home to see two smiling perfect gifts of God waiting to just make my day.

I need help. I am not accustomed to asking for it. I would assume sit in the dark than have to borrow money to pay the electricity bill. But when it comes to violating rights and companionship someone has to step up and speak up. I am not going to bash this judge; she has her reasons, and the only reason I do not agree with is that she is "not a dog person". If she seriously and genuinely feel there is a need to "protect" my daughter from these dogs, then education is the key. IF that is not the case, then a stand needs to be made.

Please offer support…and that support is making a stand with me. Pass this on to who will hear it, and to those who will and can help.

My daughter needs her father…and her father needs his daughter. And I need my babies when she isnt there. I cant begin to imagine life without any of them.

My contact information is below.

I have also included a video to "lighten things up" so to speak…but please, anything helps.

UPDATE by Lanetra Bennett: Tallahassee, Florida- December 13, 2011 – 6:42 P.M

A group called the Red Dawg Order is believed to have been behind a hazing incident that landed an 18-year-old in the hospital and three FAMU Marching 100 members in jail.

FAMU senior Joel McGuire says he was in the Marching 100 in 2008. He says while he never had any problems, he’s not too surprised that three band members were arrested for hazing Monday.

"I didn’t experience any type of hazing physically or mentally," McGuire says. "It’s all about accountability. Somebody should be held accountable. That’s the only way things are going to change."

Tallahassee Police say Sean Hobson, Aaron Golson, and James Harris beat 18-year-old band mate Bria Hunter so severely that she had blood clots in her legs, deep bone bruising and a cracked femur.

Our cameras were rolling when two of the three men were released on bond Tuesday.

Officers say the students are members of Red Dawg Order, which is a subgroup formed by students for band members who are from Georgia.

McGuire says there are several organizations, or "regional frats" within the band.

Red Dawg Order is even a registered incorporated company and has spread nationwide to colleges with large marching bands.

Joel says, "It’s not anything that you have to do, they don’t try to like put pressure on you, like oh you have to join this organization if your from this, or you have to join this organization if you’re from that. Its all a choice."

————————————————————————————

Tallahassee, Florida – December 13, 2011 – Noon -

Tallahassee police said the three men arrested were involved in hazing Hunter at an off-campus apartment because she tried to get out of a meeting and couldn’t recite information about their clique of Georgia natives, known as the "Red Dawg Order."

Authorities said James Harris, 22, helped plan the hazing at his apartment and, at one point, he stopped the other two men from hitting Hunter further. He has been charged with hazing and his bond was set at ,500.

Harris’ attorney, Eric Abrahamsen, insisted there was no evidence his client took part in the hazing and that he would fight the charges.

Sean Hobson, 23, and 19-year-old Aaron Golson, were charged with hazing and battery, and their bail was set at ,000. An attorney for Golson said he would also plead not guilty. Golson was released from jail and ducked into a car driven by his mother. He refused to answer any questions.

Hobson did not yet have an attorney.

Authorities said Hunter was targeted Oct. 31 by other members of the "Red Dawg Order" because she tried to get out of going to a group meeting. She was repeatedly punched on the tops of her thighs by Golson and Hobson, witnesses told police.

The following day, police said, Hunter was beaten with a metal ruler when she could not recite information about the "Red Dawg Order" properly.

Police said Hobson sent Hunter a text message Nov. 5 to say he was sorry.

"I apologize for the hurt I put you through. I apologize for the mental and physical strain you have endured," Hobson said in the message, according to police.

When authorities interviewed him, Hobson acknowledged he was a member of the "Red Dawg Order" but denied harming Hunter or sending her a text message.

Attorney Craig Brown, who is representing Golson, told the judge his client was a good student and should be released without bond because he was cooperating with police. Leon County Judge Ronald Flurry, however, required Golson to post a bond. The judge said if the charges were true, they were "egregious."

After the hearing, Brown said there was a "difference in the stories" of what actually took place.

Ricky Jones, director of the Center on Race and Inequality at the University of Louisville and an expert on hazing, said he had not heard of a case where a female had been beaten by males.

"This doesn’t mean it’s a first," he said. Since the band and its various groups admit men and women, mixed gender hazing might not be uncommon, Jones said.

Champion’s death exposed a hazing tradition that has long haunted the university. Former clarinet player Ivery Luckey was hospitalized after he said he was paddled around 300 times in 1998. Luckey told Tallahassee police that it was mostly girls who hit him in an initiation to become part of "The Clones."

Three years later, band member Marcus Parker suffered kidney damage because of a paddle beating.

After Champion died, the university indefinitely suspended performances by the famed Marching 100. School president James Ammons has vowed to break what he calls a "code of silence" on the hazing rituals.

Last week, the board of trustees reprimanded Ammons over his job performance, including how the university has dealt with hazing. The panel that oversees the state university system has also called for a probe into whether school officials ignored past warnings about hazing.

"The board of trustees and president Ammons hope that through these arrests all involved in perpetuating this culture will really begin to view hazing as a serious matter," said university spokeswoman Sharon Saunders.

The school fired band director Julian White, who contends he tried to report problems with hazing to his superiors. He was reinstated and placed on administrative leave because the Florida Department of Law Enforcement asked the university to halt all disciplinary actions until the investigation is finished. Four students connected to Champion’s death were expelled, but then also reinstated.

Tallahassee, Florida – December 13, 2011 – Noon -

The group that police say Bria Hunter was participating in was started in Tallahassee. Reports show that the Red Dawg Order originated with the Marching 100.

This organization was founded on December 18, 1994 in Tallahassee. A website says the basis for the organization is to establish unity, sisterhood and brotherhood for band members from Georgia at many different colleges.

Red Dawg Order originated at Florida A&M University and spread from there.

Peter W. Grayson, Sherman, Texas Historical Marker
Louisville Attorney

Peter Wagener Grayson was born in 1788 in Bardstown, Virginia (later part of Kentucky) to Benjamin and Caroline (Taylor) Grayson, members of a politically prominent family. He served in the War of 1812 and worked in Louisville as an attorney, businessman and legislator. Well-spoken in legal matters and also a poet, he nevertheless amassed substantial debts and privately combated mental illness. In 1830, Grayson wrote to Stephen F. Austin about acquiring land in Texas, and by 1832 he had established a plantation near Matagorda. He also became a friend and advisor to Austin. During Austin’s imprisonment in Mexico City in 1834, Grayson and Spencer Jack went there with petitions in hopes of freeing the empresario. In December 1834, they secured Austin’s bail, although he was not free to leave until the following summer. Settlers began preparations for revolution soon after Austin returned to Texas, and Grayson worked with him to outline an independent government. Grayson also served as president of the Council of War and aide-de-camp to both Austin and Gen. Edward Burleson. After Texas’ victory at San Jacinto on April 21, 1836, Grayson acted as interpreter and Attorney General, signing the Treaties of Velasco on May 14, 1836. Grayson went with others to Washington, D.C. to gain recognition of the Texas Republic and discuss annexation to the United States, but the efforts were unsuccessful. He served as Texas Attorney General and as naval agent, and was Sam Houston’s candidate for the Texas presidency in 1838. On July 9 of that year, though, while traveling through Tennessee, Grayson took his life, leaving a note that has previous mental illness had returned. In 1846, following the eventful annexation of Texas to the United States, the Texas Legislature created Grayson County, naming it for the Texas patriot. (2005)

I’m a member of Red Dawg Order Inc. I wanted to say that the action of these three member no way shape or form reflect the organization as a whole. I myself was shacked by the events that took place. RDO is a wonderful organization its an extension of my family.
